1. Acceptance. By using nextgenmedsolutions.com (the "Site"), you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Site.
2. Who the Site is for. The Site provides information about medical products for licensed healthcare providers and their authorized staff. Products are sold only to licensed healthcare providers, not to patients or the general public. We may verify licensure before accepting any order.
3. Medical disclaimer. NextGen Medical Solutions is a medical distribution company and does not provide direct patient care. Content on the Site is for general information and education only. It isn't medical advice and doesn't replace the professional judgment of a licensed healthcare provider or the manufacturer's instructions for use. Always refer to the full manufacturer IFU for indications, contraindications, warnings and precautions. Product descriptions reflect manufacturer labeling, and we don't promote any use outside that labeling. If you're a patient, please talk to your healthcare provider. In a medical emergency, call 911.
4. No coverage or reimbursement guarantee. Any coding or coverage information on the Site is for reference only. Coding and billing are the provider's responsibility; coverage varies by payer. We don't guarantee coverage, payment or reimbursement for any product, and we don't determine medical necessity, choose codes or submit claims.
5. No patient information. Don't submit protected health information or any other patient information through the Site or its forms.
6. Orders. Orders are subject to account approval, availability and the terms of sale we provide when you place an order. Prices aren't published on the Site.
7. Intellectual property. Site content and the NextGen name and logo belong to NextGen. Third-party product names and trademarks are the property of their respective owners. Don't copy Site content without consent.
8. Acceptable use. Don't misuse the Site, interfere with its operation, try to gain unauthorized access or submit false information.
9. Third-party links and services. The Site may link to or embed third-party services (for example, Typeform). We're not responsible for their content or practices.
10. Disclaimer of warranties. To the fullest extent permitted by law, the Site is provided "as is" and "as available" without warranties of any kind. Any product warranties come from the manufacturer.
11. Limitation of liability. To the fullest extent permitted by law, NextGen isn't liable for any indirect, incidental, special or consequential damages arising from use of the Site.
12. Governing law. These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules.
13. Changes. We may update these Terms by posting a new version on this page.
